SERIES OF TEXTS ON DIRECTIVE (EU) 2024/1385: Analysis of the law on domestic violence in BiH under EU Directive 2024/1385 in the context of emergency protection measures

It is important to highlight the importance of harmonizing the laws on protection against domestic violence in Bosnia and Herzegovina with Directive (EU) 2024/1385 in order to ensure comprehensive protection of victims of violence. The existing legal frameworks in the Republic of Srpska, the Federation of Bosnia and Herzegovina and the Brčko District of Bosnia and Herzegovina show progress in providing emergency protection measures for victims. However, a comparative analysis reveals several areas where these laws do not fulfill the requirements of the Directive, in particular with regard to the implementation and extension of protection measures.

One of the primary challenges lies in the inconsistent application of emergency protective measures in different legal jurisdictions in Bosnia and Herzegovina. The decentralized nature of the legal system contributes to differences in the availability and enforcement of protection orders, which undermines the overall efficiency and effectiveness of victim protection.

The fourth text we bring deals with the Analysis of the Law on Domestic Violence in Bosnia and Herzegovina under EU Directive 2024/1385 in the context of emergency protection measures.
