SERIES OF TEXTS ON DIRECTIVE (EU) 2024/1385: REVIEW ON CYBER STALKING, CYBER HARASSMENT AND ONLINE INCITEMENT TO HATRED OR VIOLENCE

We continue the series of texts on our website www.hcabl.org and Facebook and Instagram pages in which we analyze in detail the articles of Directive (EU) 2024/1385 on the suppression of violence against women and domestic violence.

This Directive entered into force in June 2024 and represents a legally binding instrument with which our domestic laws must also be harmonized.

The third text we bring deals with the Assessment of the Compliance of the Criminal Legislation of Bosnia and Herzegovina with Directive (EU) 2024/1385: Review on Cyber Stalking (Article 6), Cyber Harassment (Article 7) and Online Incitement to Hatred or Violence (Article 8).

In an era characterized by rapid technological advances and the pervasive influence of the Internet, the landscape of criminal activity has changed significantly.

Directive (EU) 2024/1385 has become a key legislative instrument in this regard, which focuses in particular on the fight against domestic violence and violence against women, and provides for the criminalization of cyber stalking, cyber harassment and online incitement to hatred or violence – three forms of online misconduct that are becoming more widespread.

In assessing the compliance of the criminal legislation of Bosnia and Herzegovina with Directive (EU) 2024/1385, which mandates the criminalization of cyber stalking, cyber harassment and online incitement to hatred or violence, it is obvious that the legal frameworks in Bosnia and Herzegovina show different degrees of compliance.
